Summary
- The CFTC proposes federal registration rules for cryptocurrency exchanges offering leveraged and margined trading products to retail investors across America.
- Regulation CTX and Regulation CAM would establish operating standards and investor protections while preserving existing state licensing options for exchanges.
- Â The proposal follows the CLARITY Act’s Senate failure as federal regulators pursue alternative measures to strengthen cryptocurrency market oversight.
The US Commodity Futures Trading Commission (CFTC) is seeking to bring leveraged retail cryptocurrency trading under a unified federal regulatory framework. On October 12, the agency launched a rulemaking process proposing new registration standards for exchanges offering leveraged and margined crypto products.
According to the CFTC’s announcement, the initiative introduces Regulation CTX and Regulation CAM to establish a federal registration pathway. The proposals would create a new category of CFTC-registered exchanges known as crypto asset markets.
Through this arrangement, eligible platforms could operate under federal supervision rather than relying exclusively on state licensing systems. CFTC Chairman Michael Selig explained that the initiative aims to improve regulatory clarity while strengthening protections for cryptocurrency investors.

CFTC Proposes New Exchange Registration Standards and Stronger Investor Protections
Under the proposed regulations, cryptocurrency exchanges offering leveraged products would need to meet specific federal operating requirements. These standards would govern participating platforms and establish consistent oversight for qualifying retail cryptocurrency transactions.

Importantly, the framework would provide an alternative registration option without requiring every cryptocurrency exchange to operate under CFTC supervision. Selig clarified this limitation in a Wall Street Journal column outlining the commission’s proposed regulatory approach.
He explained that Congress must authorize any requirement forcing cryptocurrency assets to trade exclusively on federally registered platforms. As a result, the proposed framework would not automatically replace existing state licensing arrangements.
Consumer protection also forms a central part of the initiative, particularly concerning fraud prevention and exchange accountability. Selig referenced the FTX collapse while emphasizing the need for regulations that prevent misconduct rather than merely punish violations. The commission intends to address these concerns through clearer operating standards and stronger federal oversight of participating exchanges.
CFTC Advances Crypto Rulemaking Following CLARITY Act Failure
The regulatory initiative follows the Senate’s failure to pass the CLARITY Act in September, leaving comprehensive cryptocurrency legislation unresolved. Federal agencies have consequently pursued separate measures within their existing authority to address outstanding digital asset regulatory issues.
In September, the Securities and Exchange Commission introduced an innovation exemption as part of its cryptocurrency regulatory efforts. Meanwhile, the CFTC submitted cryptocurrency rulemaking plans for White House review before announcing its proposed exchange registration framework.
Together, these measures demonstrate how regulators are developing cryptocurrency oversight mechanisms without waiting for broader congressional legislation. For exchanges, the proposed CFTC framework would introduce another registration pathway while preserving existing regulatory options.
The rulemaking process will determine the final operating requirements and consumer safeguards governing federally registered cryptocurrency trading platforms.
